Terms at a glance

  • Use Hoist only for lawful business due diligence.
  • You are responsible for activity under your account, including connected AI tools.
  • Tool-specific verification responses can show source results; Evidence Pack exports are prelaunch fixture or unsearched samples. Neither is legal, credit, tax, or financial advice.
  • Current workflows are free; any legacy or future payment, refund, availability, and liability terms are limited as set out below.

1. The agreement

By using Hoist, you agree to these terms. "Hoist" means the website, API, MCP server, and dashboard operated by HoistAI Pty Ltd (ABN 11 695 718 659) ("we", "us"). "You" means the individual or organisation accessing the service.

2. Your account

  • You must be at least 18 and authorised to bind the organisation you're signing up for.
  • Keep your account access private. You're responsible for activity under your account and user accounts.
  • One human per account. Don't share logins.

3. What you can do

Within applicable laws and the access enabled for your account, you can use Hoist for ABN/GST lookups, record retrieval, and other functions expressly made available to your account. PPSR preview and paid search are currently unavailable and fail closed without a price or register dispatch. A credential, scope, account, subscription, or plan does not unlock them; these terms do not grant current PPSR access. You may access available service surfaces through MCP, REST API, CLI, or connected AI clients where enabled.

4. What you can't do

  • Attempt to circumvent the org-only boundary (the system rejects individual-grantor searches; don't try to fool it).
  • Resell our service as a wholesale product without a separate written agreement.
  • Use the service to harass, surveil, or otherwise harm individuals - Australian law and this policy set clear limits.
  • Reverse-engineer Hoist or try to work around usage limits, billing checks, source-access rules, or account controls.
  • Run automated workloads at a volume that materially degrades the service for others (fair-use rate limits apply).

4a. AI-agent and automated access

You may connect AI tools or automated clients to the service using access issued to your account. You remain responsible for all searches and actions performed under your account, whether initiated by a human or an AI agent.

An AI agent accessing the service must operate within the same acceptable-use boundaries as a human user (see Acceptable Use Policy). Connecting an AI tool does not transfer responsibility for compliance to the AI tool provider.

Tool-specific verification responses show what supported source registers say at the time of the check. The separate create_evidence_pack path creates an owner-bound prelaunch sample export whose ABR, GST, VIN, and PPSR rows are fixture or unsearched data. A returned pack_id alone does not prove that an export was persisted.

  • They do not guarantee that a transaction is safe, lawful, compliant, commercially sound, or likely to be approved by a lender.
  • They do not confirm that a transaction will proceed, that an asset will remain unencumbered, or that a counterparty will perform its obligations.
  • Hoist PPSR preview and paid search are currently unavailable. If a paid search is enabled only after product launch approval, it will require confirmation before it runs.
  • BSB/account details do not prove account control.

Do not rely on any Hoist verification response as the sole basis for a significant financial decision without applying your own professional judgment. Do not use a sample Evidence Pack as source evidence at all.

5. Pricing and payment

  • Currently available Hoist workflows are free to call. ABN lookup, GST status through counterparty verification, and invoice-risk review have no per-call charge.
  • Hoist does not currently meter opportunity searches, on-demand delta reports, sample Evidence Pack exports, or other available workflows.
  • Billing infrastructure is reserved for future paid-source workflows. No current workflow requires billing setup, and paid PPSR search and pricing remain unavailable.
  • If a paid-source workflow launches, its AUD base price and GST-inclusive total will be shown before confirmation and card processing will be handled by Stripe.

6. Cancellation and refunds

  • No current workflow creates a new paid subscription or paid-source order.
  • Existing legacy billing relationships can be managed through the signed-in Stripe portal.
  • If a future paid-source workflow launches, its cancellation, dispute, and refund terms will be presented before purchase and remain subject to Australian Consumer Law.
  • Records remain accessible for the published retention period after account closure or any future cancellation.

7. Service availability

We target 99.9% monthly availability for the API and MCP endpoints. We don't promise individual checks will always succeed - external sources and registers can go offline for maintenance. Current workflows are free, and unavailable source paths fail closed. Any future paid-source terms will address failed dispatches and source-provider fees before purchase.

8. Data ownership

  • You own the records you generate. Export, delete, or transfer any time.
  • We retain the right to keep verification hashes indefinitely (no PII) so historic records can still be checked.
  • Aggregated, de-identified usage statistics may be used by us for product improvement and benchmarking.

9. Liability

We provide the service "as is" subject to the Australian Consumer Law (which can't be excluded). Our aggregate liability for any claim is capped at the fees you paid us in the 12 months preceding the claim. We're not liable for indirect, consequential, or lost-profit damages.

To be plain about it: don't rely on a Hoist record as the sole basis for a multi-million-dollar credit decision without doing your own broader due diligence. We're one piece of evidence; not the whole picture.

10. Changes to the service or terms

We may update the service and these terms. Material changes get 30 days notice by email plus a /changelog entry tagged terms. Continued use after the effective date means acceptance; if you don't accept, stop using the service and close your account before the effective date. No current workflow creates a paid subscription, so this clause creates no current subscription-refund entitlement. Any legacy or future paid relationship remains governed by its applicable written terms and Australian Consumer Law.

11. Governing law

Laws of New South Wales, Australia. Exclusive jurisdiction in NSW courts. We'd much rather work it out by email first.
